Mesothelioma attorneys win $208.8 million jury verdict in California asbestos case

It has been reported that a Los Angeles jury decided an asbestos case in favor of a woman suffering from malignant mesothelioma, an asbestos cancer. The jury returned a verdict of $208.8 million, reportedly the largest asbestos verdict in the State of California.

The mesothelioma attorneys retained by the woman and her husband alleged that the woman was exposed to deadly asbestos fibers from cleaning the clothes of her husband, a retiree who had worked with asbestos-containing products.

The husband had worked for the Los Angeles Department of Water and Power. In that position, he was exposed to asbestos dust from asbestos cement water pipes made by CertainTeed. It is likely that asbestos fibers clung to his work clothing and his wife was exposed to them when she washed those clothes. Such a form of asbestos exposure is known as secondary asbestos exposure.

According to a mesothelioma attorney who represented the couple, the jury awarded $8 million in compensatory damages against the Department of Water and Power and CertainTeed Corp. In addition, the jury awarded $200 million in punitive damages against Certain Teed.

Malignant mesothelioma cancer is almost always caused by exposure to asbestos. Two common types of mesothelioma are pleural mesothelioma and peritoneal mesothelioma. Pleural mesothelioma is a cancer of the lining of the lungs and is commonly referred to as lung mesothelioma while peritoneal mesothelioma is a cancer of the lining of the abdomen. Both types of mesothelioma cancer typically develop decades after exposure to asbestos has taken place. Frequently, asbestos exposure occurs in the workplace. Workers at risk of asbestos exposure include mechanics, construction workers, sheet metal workers, construction workers and plumbers.

By the time a person is diagnosed with mesothelioma, treatment options are usually limited. While there is presently no cure for mesothelioma, there are treatment techniques that have shown some degree of effectiveness. These treatment techniques include surgery, chemotherapy, radiation and photodynamic therapy (PDT). Further, clinical trials at many research institutions are underway to test the effectiveness of experimental drugs for mesothelioma. People who have been diagnosed with mesothelioma cancer should consider participating in these clinical trials after consulting with their doctor.
